Elvish Yadav, a prominent YouTuber, is facing intensified legal scrutiny as Gurugram Police prepare to interrogate him in connection with a First Information Report (FIR) filed against him in Sector 53 of Gurugram. The charges stem from an alleged altercation involving Yadav and YouTuber Sagar Thakur. It is anticipated that Gurugram Police will seek a production warrant to question Yadav, who has been transferred from a quarantine cell to a high-security barrack after two days in custody.
Noida Police, meanwhile, has escalated the legal proceedings against Yadav by including sections 8, 20, 27 & 27A, 29, 30, and 32 of the Indian Penal Code (IPC) under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. This decision follows confirmation from the Forensic Science Laboratory (FSL) regarding the presence of snake venom. Yadav had reportedly met with his father and other close associates while in jail.
The application of NDPS 27A carries significant legal implications, necessitating recourse to the High Court. DCP Noida Vidya Sagar Mishra emphasized that the investigation is meticulously examining all individuals involved, with plans to question Haryanavi singer Faizalpuriya among others. The police are actively preparing a chargesheet in the case.
In a development that compounds Yadav’s legal challenges, a video has emerged showing him promoting online betting to his followers. The video, posted on Facebook last year, encouraged viewers to participate in online betting as a means of earning money.
Supreme Court Advocate Bharat Sisodia provided insight into the legal sections imposed on Yadav, explaining that Section 8/20 of the NDPS Act pertains to possession of ganja or similar substances, while Section 27 relates to the involvement of an accused in the use of narcotic drugs. Section 27A is invoked when an individual aids in the purchase or financing of narcotic drugs. Section 30 is applicable when an individual is accused of planning the financing or consumption of such drugs.
